Sin embargo, el gobierno entrante de Abelardo de la Espriella buscaría frenar en seco este proceso usando argumentos que mezclan imprecisiones con datos incorrectos.

00:00You may have seen posts or videos about CETI in recent days,
00:05indigenous territorial entities.
00:20People close to the incoming government, such as the incoming Minister of the Environment, Fabio Arjona,
00:25or Enrique Gómez, director of the National Salvation Movement, head of debate for Abelardo de la Espriella
00:30and the senator-elect, have revealed de la Espriella's intention to put a stop to the CETI project,
00:36a promise that the Colombian State has taken more than three decades to fulfill to indigenous peoples.
00:41The problem is the arguments being used to support that idea
00:45They are mixing inaccuracies with incorrect data.
00:48Let's take it one step at a time.
00:50Let's start by quickly explaining what CETIs are.
00:53The Political Constitution, in its article 286, established that they are territorial entities
00:59the departments, the districts, the municipalities and the indigenous territories.
01:04In the latter, the traditional authorities are responsible for autonomous administration.
01:08the legally constituted territories to safeguard their survival and preserve their worldviews.
01:15Until just over a year ago, the CETI were the only territorial entities contemplated in the Constitution
01:21that did not exist.
01:23Although the Constitution delegated to Congress the responsibility of issuing the necessary regulations,
01:28He never did, despite the fact that 14 bills were introduced.
01:32which ended up shelved and more than 30 years delayed.
01:36The Constitution, anticipating this delay, established in another article
01:40that the National Government could issue the regulations for the operation of the CETI.
01:45This is what has been happening since the government of Juan Manuel Santos, with, for example,
01:49the issuance of Decree 632 of 2018, which established the phases for them to be put
01:54CETI is now operational.
01:56Since then, dozens of indigenous communities, mostly in the Amazon,
02:01They have been adopting its operation and fulfilling a series of criteria to advance in that process.
02:05But the last decrees were only issued during Gustavo Petro's administration.
02:10so that, in December of last year, the first eight indigenous territorial entities were formalized.
02:16who came in to complete the map of Colombia that we are all taught in school.
02:21So, what do we have so far?
02:23The CETIs, contrary to what has been said, are constitutional, as they reiterate
02:28Alejandro Ballesteros, public administrator and advisor for the implementation of CETI,
02:32and Paulo Baca, director of the Environmental Justice Line of Ejusticia.
02:36And while there has been significant progress during the last administration,
02:39They are not an invention of Petro, much less neo-municipalities in the Petro style.
02:44That's why many of Petro's and Benedetti's political allies are happy.
02:49because the Ministry of the Interior hands over these new municipalities in the Petro style.
02:54That said, as they are just another territorial entity,
02:57It is also not true that the Constitution and the Penal Code will not be applied there.
03:02the general rules that govern territorial entities,
03:04nor that they will spend without any supervision
03:07those transferred from the General System of Participations to which they can now have access.
03:13Quite the opposite, in fact.
03:15As a territorial entity, they will have to coordinate.
03:18as do the departments, districts, and municipalities,
03:21with the institutions of the Colombian State.
03:23And that implies that the Comptroller's Office, the Attorney General's Office, and the Prosecutor's Office
03:27They will exercise fiscal, disciplinary, and criminal control.
03:30as in any other part of the national territory.
03:32In other words, they are neither autonomous territories nor federal territories.
03:37nor independent republics.
03:39Communities of ethics are already formalized,
03:42like Antonio Matapiyucuna, from the ETI Milití Paraná,
03:46as well as people from civil society organizations,
03:49who have accompanied this process for more than three decades,
03:51Like Ballesteros and Vaca, they are calling on the incoming government of Espriella,
03:55that it fulfills its commitment to respect the Constitution
03:58and sits down to talk with them.
